By using our website or placing an order, you agree to comply with these Terms and Conditions, together with any applicable policies referred to below. If you do not agree with these Terms and Conditions, please do not use our website.

These Terms and Conditions apply to retail customers. Any separate terms agreed in writing for wholesale or trade transactions will apply to those transactions where relevant.

Nothing in these Terms and Conditions excludes or restricts any statutory rights you have as a consumer under UK law.

  • Returns, Refunds and Exchanges Policy.
  • Delivery Policy.
  • Warranty Policy.
  • Privacy Policy.
  • Cookie Policy.
  • Care Guide.
  • Ring Sizing Guide.
  • Hallmarking Policy.

These documents provide further information about specific aspects of our products and services.

Where a policy describes a customer's statutory rights, those rights take precedence over any conflicting provision in our policies or these Terms and Conditions.

Eligibility and Use of Our Website

You must provide accurate information when placing an order, making a booking or contacting us.

If you create an account on our website, you are responsible for keeping your login details confidential and for notifying us if you suspect unauthorised access.

You must not use our website for unlawful purposes, attempt to interfere with its security or functionality, or submit information that is knowingly false or misleading.

Our website is intended for lawful personal and business use. Products purchased through our retail website must not be resold as part of a commercial activity.

Products and Product Descriptions

We aim to ensure that product descriptions, photographs, prices, dimensions, materials and other information on our website are accurate and up to date.

However, minor variations in colour, appearance or finish may occur due to lighting, photography, screen settings, manufacturing processes or the natural characteristics of materials.

Where relevant, product descriptions will identify the materials, sizes, finishes and other important characteristics of individual items.

Please review product descriptions carefully before placing an order, particularly where sizing, precious metal content, plating, gemstones or suitability for sensitive skin is important to you.

Nothing in this section limits your statutory rights if goods are not as described, are not of satisfactory quality or are not fit for their intended purpose.

Prices and Payment

All prices will be displayed on our website in the currency stated at checkout.

Any applicable taxes and delivery charges will be shown or explained before you complete your purchase.

We take reasonable care to ensure that prices are accurate. If a genuine pricing error is identified, we will contact you to discuss the available options before proceeding where appropriate.

Payment must be made using one of the payment methods offered at checkout.

Payments may be processed by third-party payment service providers. We do not intend to store full payment card details or card security codes ourselves.

Your payment information will be handled in accordance with our Privacy Policy and the relevant payment provider's terms.

Placing an Order and Formation of Contract

When you submit an order through our website, you are making an offer to purchase the selected goods on the terms displayed at checkout.

An automated order acknowledgement confirms that we have received your order. It does not necessarily mean that your order has been accepted.

A contract will generally be formed when we confirm acceptance of your order or dispatch the goods, as specified in our order process.

If we cannot fulfil an order because an item is unavailable or there is a genuine error affecting the order, we will contact you and arrange an appropriate cancellation and refund where required.

We will not charge you for goods that we do not supply, except where a lawful charge has otherwise been agreed.

Stock Availability

All orders are subject to stock availability.

If an item is temporarily unavailable or we need to obtain stock from a supplier, delivery may take longer than expected.

Where this affects your order, we will contact you to explain the situation and provide an estimated delivery timeframe where possible.

If we cannot fulfil your order, we will explain the available options, including cancellation and a refund where applicable.

Delivery

Our preferred delivery provider is Royal Mail. The delivery services available, applicable charges and estimated delivery times will be displayed at checkout or explained in our Delivery Policy.

Estimated delivery times are guidance unless a specific delivery commitment has been expressly confirmed.

Please ensure that your delivery address is accurate and complete.

If a parcel cannot be delivered, we may contact you to arrange redelivery or discuss the next steps.

We remain responsible for delivery in accordance with applicable consumer law. We cannot exclude liability where goods are lost or damaged before they come into your possession, except where a lawful exception applies.

Further information is available in our Delivery Policy.

Cancellation, Returns and Refunds

If you purchase goods online, you may generally cancel your order under the Consumer Contracts Regulations 2013 within 14 days beginning the day after you receive the goods, subject to applicable exceptions.

Following notification of cancellation, you will generally have a further 14 days to return the goods.

Ruby Pepper may offer an extended change-of-mind returns period where expressly stated in our Returns Policy or otherwise agreed with you.

Earrings and cuffs are unsuitable for return for health and hygiene reasons, unless they are damaged on arrival.

This does not remove your rights in respect of faulty, damaged or misdescribed goods.

Where a refund is due, it will be processed in accordance with applicable law and our Returns, Refunds and Exchanges Policy.

Please consult that policy for instructions on how to request a return, arrange an exchange or report a problem with an order.

Faulty, Damaged or Incorrect Goods

We take care to check our products before dispatch. However, if an item arrives faulty, damaged or different from what you ordered, please contact us at customercare@rubypepper.co.uk.

Please provide your order number and a description of the issue. Photographs may help us assess the problem.

Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for their intended purpose and as described.

Depending on the circumstances, you may be entitled to a replacement or refund.

Nothing in these Terms and Conditions limits or excludes any statutory rights or remedies that apply to your purchase.

Warranty

Ruby Pepper offers a voluntary 12-month warranty on eligible products, subject to the terms of our Warranty Policy.

The warranty is additional to your statutory consumer rights and does not replace or restrict them.

Warranty claims may require reasonable proof of purchase and information about the fault.

Please refer to our Warranty Policy for further details about the scope of the warranty, exclusions and the claims process.

Ear Piercing Services and Appointments

Where Ruby Pepper offers ear piercing services, appointments will be subject to the booking arrangements and any applicable piercing-specific terms provided at the time of booking.

Before a piercing is carried out, we will need to establish relevant information about age, consent, allergies, health considerations and suitability for the procedure.

We may decline or postpone a piercing where we reasonably consider that it is unsuitable or cannot be carried out safely, or where the required consent or information has not been provided.

Any appointment deposits, cancellation arrangements, age requirements, consent procedures and aftercare instructions will be explained in our piercing booking terms or before the appointment is confirmed.

Customers must follow the aftercare guidance provided by their piercer. If you experience concerning symptoms following a piercing, seek appropriate medical advice.

Nothing in these Terms and Conditions excludes liability where it would be unlawful to do so.

Jewellery Care and Product Suitability

Jewellery requires appropriate care, and the durability of a product may depend on its materials, finish, use and storage.

We provide a Jewellery Product Care Guide to help customers look after their purchases.

Please read the relevant product description and care guidance before use, particularly if you have known metal sensitivities or are purchasing jewellery for a fresh or healing piercing.

Descriptions such as "nickel-free" or "hypoallergenic" should be understood in the context of the specific product and its documented materials. They do not guarantee that an allergic reaction is impossible.

Following care instructions does not remove your statutory rights if a product is faulty or otherwise fails to meet legal requirements.

Hallmarking and Precious Metals

Where we sell jewellery described as gold, silver, platinum or palladium, we aim to ensure that the descriptions are accurate and that applicable hallmarking requirements are met.

Some items may be exempt from compulsory hallmarking under UK law, including qualifying items below the relevant weight thresholds.

Please refer to our Hallmarking Policy and individual product descriptions for further information.

Gift Cards and Promotional Offers

Any gift cards, discount codes or promotional offers will be subject to the specific terms communicated with the relevant offer.

Unless otherwise stated, promotional codes cannot be exchanged for cash and may not be combined with other offers.

We will explain any material restrictions, expiry dates or minimum-spend requirements before you complete a purchase using a promotion.

Nothing in this section removes any rights you have under applicable consumer law.

Intellectual Property

Unless otherwise stated, the content on the Ruby Pepper website, including photographs, product images, written descriptions, logos, branding, graphics and website design, is owned by or licensed to Ruby Pepper.

You may access and use this content for personal, non-commercial purposes connected with browsing our website and purchasing our products.

You must not reproduce, distribute, modify, commercially exploit or republish website content without our prior written permission, except where permitted by law.

All applicable intellectual property rights are reserved.

Website Availability and Security

We aim to keep our website available and functioning properly. However, we cannot guarantee uninterrupted access or that the website will always be free from errors or technical interruptions.

We may update, maintain or modify the website from time to time.

You must not attempt to gain unauthorised access to our website, interfere with its operation or introduce malicious software.

We will take reasonable steps to protect the website and customer information in accordance with our Privacy Policy and applicable law.

Third-Party Services and Links

Our website includes links to third-party websites and uses external services, such as payment providers, delivery companies, social media platforms and booking systems.

These services may operate under their own terms and privacy policies.

We are not responsible for the independent content or policies of third-party websites, although this does not exclude any responsibility we have for services or obligations for which we remain legally responsible.

Liability

Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

We are responsible for losses you suffer that are a foreseeable result of our breach of these Terms and Conditions or our failure to exercise reasonable care and skill, subject to applicable law.

We are not responsible for losses that are not reasonably foreseeable or that arise from circumstances for which we are not legally responsible.

Nothing in this section restricts your statutory consumer rights in relation to goods or services.

Events Outside Our Reasonable Control

We will not be responsible for a delay or failure to perform an obligation to the extent that it is caused by circumstances beyond our reasonable control, such as certain transport disruptions, severe weather, interruptions to essential services or other unforeseen events.

Where such circumstances arise, we will take reasonable steps to minimise the impact and keep affected customers informed where appropriate.

This section does not remove any statutory rights you may have, including rights relating to cancellation or refunds.

Privacy and Personal Information

We collect and use personal information to process orders, arrange deliveries, manage appointments, respond to enquiries and operate our business.

Our Privacy Policy explains how we collect, use, store and protect personal information and describes your data protection rights.

Placing an order does not automatically subscribe you to marketing communications. Where required, we will obtain your consent or rely on another lawful basis permitted by applicable law.

You may unsubscribe from marketing communications at any time using the instructions provided in the relevant message.

Changes to These Terms and Conditions

We may update these Terms and Conditions from time to time to reflect changes to our business, products, services or legal obligations.

The version published on our website will apply to future orders, subject to applicable law.

Changes will not retrospectively alter an existing contract unless this is agreed with you or otherwise permitted by law.

Complaints and Customer Support

If you have a question, concern or complaint about an order, product or service, please contact us.

Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of England and Wales, subject to any mandatory consumer protection laws that apply to you.

Where a dispute arises, the courts of England and Wales may have jurisdiction, subject to applicable legal rules and any rights you may have to bring proceedings in another competent court.

If any provision of these Terms and Conditions is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

A failure by Ruby Pepper to enforce a provision immediately does not automatically amount to a waiver of that provision.

Third-Party Rights

Unless expressly stated otherwise, these Terms and Conditions do not confer rights on third parties to enforce their provisions under the Contracts (Rights of Third Parties) Act 1999.
